1. Introduction

Welcome to PULSEPOINT, an HSE (Health, Safety & Environment) information and social media platform designed to facilitate the sharing, communication, discussion, and dissemination of information related to health, safety, environmental protection, workplace safety, emergency preparedness, and related topics.

These Terms & Conditions ("Terms") govern your access to and use of the PULSEPOINT platform, including its website, mobile applications, digital services, content, features, and community functions (collectively, the "Platform").

By accessing, registering for, or using PULSEPOINT, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

2. Definitions

For purposes of these Terms:

• "User Content" means Content submitted or uploaded by a User.
• "Platform Services" means all services, features, tools, and functionality provided through PULSEPOINT.

3. Purpose of PULSEPOINT

PULSEPOINT is intended to:

• Provide access to HSE-related information, education, awareness materials, and resources.
• Facilitate professional and community discussions regarding HSE matters.
• Encourage the sharing of safety observations, lessons learned, good practices, and experiences.
• Promote safety awareness and responsible environmental practices.
• Support communication and collaboration among HSE professionals, workers, organizations, educators, and members of the public.
• Provide a platform for Users to share relevant HSE Content.

PULSEPOINT is an information and communication platform. Unless expressly stated otherwise, PULSEPOINT does not provide professional, legal, medical, engineering, environmental, emergency-response, or regulatory advice.

4. Eligibility and Account Registration

Users must provide accurate and complete information when creating an account.

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• Ensuring that information associated with your account remains accurate.
• All activities conducted through your account.
• Immediately notifying PULSEPOINT if you suspect unauthorized access to your account.

Users must not:

• Create an account using another person's identity without authorization.
• Create multiple accounts for the purpose of circumventing Platform restrictions.
• Share account credentials with unauthorized individuals.
• Use automated systems to create accounts or access the Platform without authorization.

PULSEPOINT reserves the right to suspend or terminate accounts that violate these Terms.

5. HSE Information Disclaimer

Information available on PULSEPOINT is provided for general informational, educational, and awareness purposes only.

HSE information may vary depending on:

• Workplace conditions.
• Site-specific risks.
• Equipment and technology.
• Organizational procedures.
• Jurisdiction.

PULSEPOINT does not guarantee that any HSE information available through the Platform is complete, accurate, current, suitable, or appropriate for a particular workplace, activity, project, or situation.

Where a situation involves an immediate risk to life, health, safety, property, or the environment, Users should contact the appropriate emergency services, competent persons, site management, or relevant authorities rather than relying solely on information provided through PULSEPOINT.

6. User-Generated Content

Users may submit Content to PULSEPOINT, including safety observations, articles, comments, photographs, videos, discussions, lessons learned, and other HSE-related materials.

By submitting User Content, you represent and warrant that:

• You have the necessary rights and permissions to submit the Content.
• The Content does not unlawfully infringe another person's intellectual property, privacy, confidentiality, or other rights.
• The Content is not knowingly false, misleading, fraudulent, or defamatory.
• The Content does not contain unlawful, threatening, abusive, discriminatory, or harmful material.
• You have obtained appropriate consent before publishing identifiable images, recordings, personal information, or other materials relating to third parties where such consent is required.
• The Content does not disclose confidential, proprietary, classified, or commercially sensitive information without authorization.

7. License to User Content

You retain ownership of User Content that you lawfully own.

By uploading or publishing User Content on PULSEPOINT, you grant PULSEPOINT a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, format, adapt, and otherwise use the Content as reasonably necessary to operate, maintain, promote, and improve the Platform.

This license continues for as long as the Content remains on the Platform, subject to applicable law and our Privacy Policy.

PULSEPOINT does not acquire ownership of your User Content solely because you publish it on the Platform.

8. Content Standards

PULSEPOINT aims to maintain a professional, respectful, and safety-focused community.

Users must not upload, publish, transmit, or distribute Content that:

• Promotes unsafe or reckless behavior.
• Encourages violations of HSE laws, standards, procedures, or requirements.
• Deliberately provides dangerous or misleading HSE information.
• Is fraudulent, deceptive, defamatory, or materially misleading.
• Contains hate speech, harassment, bullying, threats, or discrimination.
• Contains sexually explicit or exploitative material.
• Promotes illegal activities.
• Infringes intellectual property or other legal rights.
• Reveals confidential or sensitive business information without authorization.
• Contains personal information of another person without appropriate authorization.
• Impersonates another individual, organization, or authority.
• Contains malicious software, harmful code, or attempts to compromise the Platform.
• Is primarily intended to spam, advertise, solicit, or manipulate other Users.
• Is otherwise unlawful or inappropriate for the Platform.

9. Safety Observations and Incident Information

PULSEPOINT may allow Users to share safety observations, near-miss information, incident reports, photographs, videos, lessons learned, and other HSE-related information.

Users must exercise appropriate judgment when submitting such information.

Users should not disclose:

• Personal medical information unless legally authorized and genuinely necessary.
• Personally identifiable information of injured persons or other individuals without appropriate authorization.
• Confidential investigation materials.
• Security-sensitive information.
• Proprietary company information.
• Information that could compromise an ongoing investigation or emergency response.

PULSEPOINT does not independently verify every safety observation, incident report, or statement submitted by Users.

Publication of a report or observation does not constitute confirmation by PULSEPOINT that the event, condition, cause, or conclusion described is accurate.

10. Moderation and Content Removal

PULSEPOINT may, but is not obligated to, monitor, review, moderate, restrict, edit, or remove Content.

We may remove or restrict Content that we reasonably believe:

• Violates these Terms.
• Violates applicable law.
• Creates a significant safety, privacy, or security risk.
• Infringes another person's rights.
• Is misleading or materially inaccurate.
• Is abusive, inappropriate, or harmful to the community.
• Is spam or unauthorized commercial material.

PULSEPOINT may suspend or terminate access to Users who repeatedly or seriously violate these Terms.

11. Reporting Content

Users are encouraged to report Content that they believe violates these Terms or creates a significant safety, privacy, legal, or security concern.

Reports should be made honestly and in good faith.
